JR EAST Rail PASS Search Terms of Use

Enacted March 31, 2024

JR EAST Rail PASS Search Terms of Use (hereinafter the “Terms”) shall apply to all use by Users of the information service "JR EAST Rail PASS Search" (hereinafter the “Service”) provided by East Japan Railway Company (hereinafter the “Company”).

Please be sure to read and understand the Terms before using the Service, as use of the Service is subject to agreement to the Terms.

Article 1: Changes to Terms

The Company may change the Terms, without the User’s consent, after giving notice in the manner prescribed by the Company, and said changes shall become effective when the User is able to view the notice of said changes by accessing the Service, unless otherwise provided in the Terms. After the Terms have been changed, only the changed Terms shall be valid.

Article 2: Overview of Service

1. The Service provides information about (i) an excursion pass to the destination specified by the User based on information on fares for each route held by the Company, (ii) the sales price of the excursion passes sold by the Company, and (iii) a basic fare when not using the excursion passes. The information about the basic fare in item (iii) is based on the information processed by Val Laboratory Corporation on its own responsibility. 2. The Users shall review the explanations shown on the screen of the Service, and it is necessary to agree to all parts of the Terms before using the Service. The Users are deemed to have agreed to the Terms by actually using the Service instead of following procedures for agreeing to the Terms. The Users who do not agree to the Terms shall not be permitted to use the Service.

3. The Service may be used only by the User. If a User permits any third party to use the Service, the Company shall not assume any liability to such a User or the third party.

4. In the event that a User uses services available through links from the Service, the contract for the use of such services shall be separate from the contract for the Service and is concluded directly with  companies providing the linked services. The usage conditions, etc. for services available through  links are subject to the terms of use of the services, etc. provided by linked services. The Company shall not make any guarantees with regard to services provided by  linked services, including operation or quality guarantees, and shall not assume any liability for damages, etc. caused to the Users in connection with services provided by linked services or any use thereof.

5. The function to link the Service with any services available through links may be restricted or made unavailable without notice to the Users at the discretion of companies providing the linked services. The Company shall not assume any liability for damages arising from such restriction or unavailability.

6. The Service cannot be used in any capacity by organized crime groups, members of organized crime groups, persons for whom less than 5 years have passed since leaving an organized crime group, quasi-members of organized crime groups, companies related to organized crime groups, corporate racketeers, gangsters under the guise of social movements, gangsters under the guise of political activities, organized crime groups, etc. specializing in intellectual crimes, or other similar groups or individuals.

7. In the event that the Company deems it necessary to conduct a factual investigation of a User’s use of the Service, such as when the User’s misconduct is suspected or other circumstances regarding the User’s use of the Service, the Company may request the cooperation of the User in conducting fact-finding interviews, presenting identification documents, and other necessary cooperation for the purposes of investigation. The Company reserves the right to refuse the use of the Service based on the results of a factual investigation.

8. Users shall prepare and use, at their own responsibility and expense, devices that they themselves manage and use and that are designated by the Company as being capable of using the Service (hereinafter “Compatible Devices”). The Company shall not assume any liability for any failure of the functions of any service to operate properly or any other effects that may result from the malfunction of a Compatible Device.

9. When using the Service, the Users must comply with all laws and regulations, general Internet etiquette, and technical rules, and must not use any method of input other than human hands, such as RPAs, Bot, crawler, or any other such programs. In the event that access which arouses suspicion of the operations described in this section is detected, the Company may block access or take other measures at its discretion from the standpoint of system protection, since there is a risk of disruption of the stable provision of the Service.

10. Use of the Service shall be provided free of charge, unless otherwise specified by the Company. However, any telecommunication charges that arise from use of the Service shall be borne by the User.

Article 3: Collection of Data

The information obtained by the Company and the specific handling of such information when using the Service shall be set forth in the JR EAST Rail PASS Search Privacy Policy  separately stipulated by the Company.

Article 4: Ownership of Intellectual Property Rights, etc.

1. All rights related to all contents comprising the Service shall belong to the Company or any third party who owns such rights, and the Users may only use the Service.

2. The Users shall not, without the Company’s permission, engage in any conduct that infringes on ownership rights, any intellectual property rights, including copyrights and trademark rights, portrait rights, rights of publicity, or rights to content with regard to the Service.

Article 5: Prohibited Acts

In using the Service, the User shall not perform:

(1) Acts which infringe or may infringe intellectual property rights including copyrights and trademark rights and other rights of the Company or a third party

(2) Acts which violate or may violate the privacy of a third party

(3) Acts of letting a third party obtain location information by permitting the third party to use the Service

(4) Unauthorized access to the Service, attacks on the Service, or any other act which may lead to such access or attacks

(5) Acts which obstruct or may obstruct the provision or operation of the Service or other services provided by the Company

(6) Acts which cause or may cause disadvantage or damages to the Company or a third party

(7) Criminal acts, or any acts which lead or may lead to criminal acts

(8) Acts of using all the information obtained through the use of the Service in the course of trade, or acts of making such information available for use by a third party, regardless of the method used

(9) Acts of using the Service on a terminal other than a Compatible Device (including Compatible Devices which have been illegally or unauthorizedly altered)

(10) Acts of decompiling, disassembling, or reverse engineering, etc. of the Service

(11) Acts which violate the Terms

(12) Any other acts which are or may be contrary to laws or regulations, public order, or morals

Article 6: Compensation for Damages

1. The Company makes no guarantees with regard to the authenticity, accuracy, currency, usefulness, reliability, legality, or non-infringement of third-party rights with respect to any information, etc. obtained by the Users through the Service.

2. If a User causes damages to a third party through the use of the Service or services available through links, the User shall resolve the issue at their own expense and responsibility and shall not cause any inconvenience to the Company.

3. The Users shall be liable for compensation for damages caused to the Company as a result of their violation of the Terms or the terms of use for services available through links, or any unlawful or illegal acts committed by them.

Article 7: Prohibition of Transfer of Rights & Duties

The Users shall not transfer their status as a User of the Service, nor their rights and duties based on such status, to a third party or offer them as collateral, except with the prior consent of the Company.

Article 8: Suspension, etc. of Use of Service

1. The Company may temporarily suspend the provision of the Service without any notice to the User in any of the following cases.

(1) Regular or urgent maintenance of the system for the Service

(2) If the provision of the Service is rendered impossible by fires, power failure, wars, riots, disturbances, and labor disputes, etc.

(3) If the provision of the Service is rendered impossible by natural disasters such as earthquakes, volcanic eruptions, floods, and tsunamis

(4) In the event of any suspension or failure of the communication service to be used for the Service

(5) In the event of communication failure for reasons of the usage environment of Compatible Devices or other reasons

(6) If the Company otherwise determines that temporary suspension of the provision of the Service is necessary for operational or technical reasons

2. In the event that the Company notifies the Users of temporary suspension of the Service, it shall be done in a manner prescribed by the Company. However, this does not apply in cases of emergency or when unavoidable circumstances prevent notification. The Company shall not assume any liability for damages caused to the User as a result of measures set forth in the preceding paragraph (including unavailability of the Service due to suspension or termination of the Service).

Article 9: Termination or Modification of the Service

1. The Company may terminate linkage of the Service with any services available through links without any notice to the User.

2. The Company may modify or terminate the provision of the Service without any notice to the User. In the event of termination of the provision of the Service, the Terms shall terminate concurrently with the termination of the provision of the Service.

3. Notwithstanding the provisions of the preceding paragraph, Articles 4 through 7 of the Terms shall remain in effect even after termination of the Terms.

Article 10: Company’s Disclaimers

1. The Company shall not assume any obligation or liability to the User when it modifies or terminates linkage of the Service with any services available through links in accordance with Article 9 of the Terms.

2. Any dispute between a User and a company providing linked services shall be resolved by the User and the company, and the User shall not make any claims or complaints against the Company in connection with such a dispute.

3. The User shall acknowledge that all or part of the Service is unavailable in any of the following cases and that the Company shall not assume any liability for loss or damages caused to the User or a third party as a result of such unavailability (except for loss or damages, etc. arising from gross negligence or willful misconduct by the Company).

(1) If the User’s Compatible Device or its peripheral equipment, etc. is not correctly installed or connected, or such a device, etc. does not operate properly due to failure, damage, or defects, or normal communication is obstructed by failure, damage, or defects of the communication environment, or in the event of inoperability due to a combination of the situations above, or if the function setting is such that the use of the Service or individual services is obstructed

(2) If the User does not comply with provisions of instruction manuals of the Compatible Device or its peripheral equipment

(3) If electric power is not normally supplied to the Compatible Device or its peripheral equipment, etc. (due to reasons such as a dead battery in the Compatible Device)

(4) If the User has not been turned on the Compatible Device or its peripheral equipment, etc.

Article 11: Governing Laws

The laws of Japan shall apply to the formation, validity, performance, and resolution of the Terms.

Article 12: Governing Jurisdiction

The Tokyo District Court shall have exclusive jurisdiction in the first instance over any and all disputes related to the Terms and the Service.
